Luke Stout was last seen between 3 and 5 p.m. on July 18, 2012 near his residence on Hickory Flat Road. He left his residence on foot and has not been seen or heard from since. Luke would not go off on his own without making contact with family and friends. He lived at home with his mom to help take care of her as she has a critical illness and is at end-of-life. Prior to his disappearance, Luke was threatened with a gun that left an imprint on his forehead, according to his family.

BUCKHANNON — “Killed by shooting, stabbing and cutting.”

That’s what police say happened to 29-year-old Joshua Oberg after a Buckhannon man allegedly paid for his murder.

Rodolfo “Chino” Villagomez Correa, 32, allegedly made “a substantial cash payment” to Jesse Lee Heater, 28, of Buckhannon, to kill Oberg, who was last seen January 23 and was reported missing on January 27, according to the criminal complaint in the Upshur County Magistrate Clerk’s office.

Villagomez was arrested Tuesday for being an accessory before/after the fact to first-degree murder. Heater and Robert Eugene Siron III, 30, of Weston, were arrested the same day for first-degree murder.

According to the criminal complaint, Oberg was last seen being transported in a vehicle with Heater and Siron on January 23. He was missing for nearly six months before police received information from a confidential informant and on Monday discovered what are believed to be Oberg’s remains in a shallow grave off Bull Run Road, near Abbott.

The remains have been sent to the medical examiner’s office for positive identification.

According to the criminal complaint, Siron allegedly told the informant that he and Heater had “buried Mr. Oberg at a specific location in Upshur County after killing him as part of a planned attack.”

Siron allegedly witnessed Villagomez giving Heater a substantial cash payment soon after the killing. Siron then received a portion of that money, according to the complaint.

No motive has been released, and it’s not entirely clear how the three suspects knew each other.

Villagomez has been named as the owner of Michoacan Mexican Restaurant in previous stories, although the Secretary of State’s website lists just one officer, his wife, Kelli Villagomez, and names the incorporator as Corporation Service Company of Delaware.

According to a February 2010 story, Siron’s home — located in Abbott near Bull Run Road ­— burned down. In that story, his wife said that Siron worked full time at Michoacan.

Chino and Kelli Villagomez are also named in a 2011 story as the owners of another Buckhannon restaurant, Santi’s (listed on the Secretary of State’s website as “Santi’s Holligans Inc.” with Kelli as the incorporator). That’s where Oberg worked, but the restaurant burned down on January 9, 2012 — exactly two weeks before he went missing.

The state fire marshal’s office did not return messages concerning the status of their investigation into the fire, and Buckhannon Fire Chief Mitch Tacy said the case had been turned over to a private investigator.

Both Siron and Heater have extensive criminal records.

In addition to the 2010 charges of nighttime burglary and petit larceny mentioned in Wednesday’s article, Heater’s criminal history includes four domestic battery third offense charges, all felonies. One of those was dismissed in 2003.

Heater also faced three destruction of property charges, a littering charge and two charges of domestic battery, all from 2002.

Siron was arrested in December 2010 after allegedly taking two 15-year-old juvenile girls from Buckhannon-Upshur High School without permission from their parents or school authorities and giving them alcohol and marijuana.

According to a previous story, Siron initially faced four felony charges — two counts of attempted sexual assault in the third degree and two counts of child concealment. That story says Siron allegedly offered one 15-year-old money in exchange for sex.

He later pled guilty to two counts of contributing to the delinquency of a minor and was given six months in jail. The sentence was suspended and he was placed on two years of unsupervised probation.

The felony charges were dismissed based on the misdemeanor pleas, according to records in the Upshur County Circuit Clerk’s office.

Siron was also arrested for joyriding and unlawful consumption in 2001 and possession of a controlled substance less than 15 grams in 2005.

Villagomez had no previous criminal record on file in the Upshur County Courthouse.

Judge Thomas Keadle said Thursday afternoon he denied bond for Villagomez, Siron and Heater in hearings held in Upshur County Circuit Court.

In the case of Villagomez, the criminal complaint notes that “in the case of every felony, every principal in the second degree, and every accessory before the fact, shall be punishable as if he were the principal in the first degree.”

Preliminary hearings have been set for Monday at 9:30 a.m. for Heater, Monday at 1:30 p.m. for Siron and Tuesday at 1:15 p.m. for Villagomez before Magistrate Juanita Adams.

Heater and Villagomez are in the Tygart Valley Regional Jail and Siron is in the North Central Regional Jail.

The West Virginia State Police were assisted by the Federal Bureau of Investigation.

State police are also investigating whether another current missing persons case has any connection to Oberg’s disappearance.

Investigating officer Trooper Roy Moss confirmed Wednesday that troopers are looking into whether there is a connection between Oberg’s case and the disappearance of Luke Stout, who was last seen July 18 and reported missing on Saturday, July 21.

Senior Trooper J.A. Rich is the lead investigator in Stout’s case.

Michoacan remained open as of Thursday, but an employee would not comment further on the restaurant’s future plans.

" When oberg went missing, there were lots of posts here about what people thought happened and who was responsible (Chino and Heater), people even gave statements, and they were questioned, but denied everything. DUH If the cops were talking, I bet they'd tell us all 3 of those in jail have been questioned about Luke too, but they clammed up. There are probably others in the community who also know "something" about Luke's disappearance, but I bet they're too scared to talk. I bet it will all come out one day, but the waiting must be horrible for his family."

Look I had the opportunity to occupy the house Chino had the beginning of this year iv done my best to search the property but their are places I couldn't get to like the 12 inch slab of concrete, coming out the side door on to the red porch it measures 6x7 and why so thick? Another is under the kitchen where Chino remodeled its weird that there is 2 layers of 5/8 OSB, 2 layers of Rockboard. On top of that there's 3 inches of self leveling cement plus the tile. So why so much effort for a kitchen floor. Hmmmmmmm
